The Regional Coordination Unit has contracted with the International Federation for Red Cross and Red Crescent Societies (IFRC) for the commission of a series of three similar research studies on Legal Preparedness for Responding to Disasters and Communicable Disease Emergencies in the Cambodia, Lao PDR and Vietnam. The studies are managed by the International Federation for Red Cross and Red Crescent Societies (IFRC) International Disaster Response Laws, Rules and Principles (IDRL) Asia Pacific Unit with technical support from the World Health Organization (WHO) and funded by the regional Pooled Fund of the (ADB-funded) Greater Mekong Subregion Communicable Disease Control Project.

 

Objectives
Through legal research and consultations, this study will:
  • Identify gaps and areas of good practice in addressing legal issues and implementing the key regional and international instruments relevant to disaster and communicable disease emergencies in Laos
  • Recommend measures to minimise legal barriers and encourage effective national and international responses to disasters and communicable diseases in Laos

 

Methodology
The Project will involve a number of research processes including:

  • Research into the most likely disaster communicable disease scenarios in each of the three countries • Legal research into the national legal and policy framework of each of the three countries for disaster and communicable disease control.
  • Examination of the implementation of key international and regional agreements, guidelines and other instruments, in particular the Guidelines for the Domestic Facilitation and Regulation of International Disaster Relief and Initial Recovery Assistance of 2007 (IDRL Guidelines) and the International Health Regulations of 2005 (IHR).
  • The identification of key legal issues likely to affect a national and international response to a large scale disaster or communicable disease emergency
  • Analysis producing findings and recommendations on good practices and further legal preparedness measures which could be implemented to improve response. The Project will also be guided by number of nominated Focal Points including from the countries’ Government, National Red Cross offices, ADB, UN agencies, NGOs and others. It will also benefit from advice received by other national groups and forums in Laos involved in discussing disaster management and communicable disease control.

 

Major expected outputs

  • A Study Report containing the findings and recommendations, as well as a collection of key national, regional and international materials.
  • A follow up High Level Workshop with key stakeholders to review the findings and encourage the development of a multi-stakeholder plan of action for implementing the recommendations.

This report is the result of legal research taken within the framework of the Project on Legal Preparedness for Responding to Disasters and Communicable Disease Emergencies in Viet Nam. This forms part of a series of studies to encourage greater legal preparedness in countries of the Greater Mekong Sub-region, including Lao PDR and Cambodia. The Project was managed by the International Federation of Red Cross and Red Crescent Societies (IFRC) with technical assistance from World Health Organization (WHO), supported by Asian Development Bank (ADB)-funded Pooled Fund of the Greater Mekong Sub-region Communicable Disease Control Project.

This legal research study was conducted in Lao PDR between March and August 2009. The study aims to:

  1. Identify gaps and areas of good practice in addressing legal issues and implementing the key regional and international instruments relevant to disaster and communicable disease emergencies in Laos;

This legal research study was conducted in Cambodia between June 2008 and April 2009. The study aimed to:

  1. Identify gaps and areas of good practice in addressing legal issues and implementing the key regional and international instruments relevant to disaster and communicable disease emergencies in Cambodia;
